HC Asks For Withdrawal of Better Class Facilities to Murder Accused in Jail

The Punjab and Haryana high court on June 10, 2013 directed the states of Punjab, Haryana and Chandigarh administration to immediately withdraw better class facilities provided in jails to persons involved in murder cases.

While issuing the directives, the division bench comprising Chief Justice Sanjay Kishan Kaul and Justice Augustine George Masih has directed the governments to file a status report after modifying the circulars, which permit better class facilities to murder accused or convicts.

The case would come up for further hearing on August 7. The order has come in the wake of a PIL filed by advocate H C Arora seeking quashing of jail manuals of Haryana, Punjab and UT Chandigarh providing for classification of prisoners. The petitioner has contended that classification of prisoners on the basis of family background or income or education level is unconstitutional, as it violates Articles 14 and 15 of the Constitution.
